Terms of Service

These Terms of Service ("Terms") govern your use of topographicaltouch.com (the "Site") and your interactions with Topographical Touch Massage & Bodywork LLC ("we," "us," or "our") through the Site, including service requests, appointments, purchases, gift cards, and other available features. By using the Site or completing a transaction, you agree to these Terms. If you do not agree, do not use the Site.

You must be legally able to enter into a binding agreement or use the Site with the involvement and permission of a parent or legal guardian. You agree to provide current, complete, and accurate information and to keep control of any passwordless access link sent to you.

You may be able to book without creating a password. A booking or purchase can create a customer record that supports confirmations, changes, transaction history, saved payment methods where offered, and passwordless account access.

Service descriptions, availability, duration, pricing, deposits, cancellation windows, and other booking terms are shown on the Site or provided to you before confirmation. You are responsible for reviewing those details and any service-specific instructions.

Cancellation, rescheduling, no-show, late-arrival, and refund rules disclosed during booking or confirmation apply to the appointment. To the extent permitted by law, deposits or fees may be nonrefundable when clearly identified as such.

We may decline, cancel, or reschedule a service when reasonably necessary, including for availability, safety, suitability, suspected fraud, or misuse. If we cancel a prepaid service and do not provide a replacement, we will provide the remedy required by the disclosed policy and applicable law.

If products are available for online or in-person purchase, descriptions, prices, availability, delivery or pickup terms, and any return policy presented at the time of sale apply. Product images and colors are illustrative and may vary by device or production batch. We may correct errors, limit quantities, or cancel an order affected by an availability or pricing error, subject to applicable law.

Gift cards, packages, memberships, discounts, and promotions may have additional terms, eligibility rules, expiration dates, or usage limits disclosed with the offer. Nothing in these Terms limits non-waivable rights under gift-card, consumer-protection, or other applicable law.

Prices may change before you complete a booking or purchase. The price, taxes, fees, deposits, and other charges presented for review at confirmation are the charges that apply, except in the case of an obvious error. You authorize us and our payment processor to charge the selected payment method for approved amounts.

Payment-card transactions are handled by a third-party payment processor under its own terms and privacy policy. We do not receive or store your full card number. You are responsible for any bank, card issuer, currency conversion, or similar third-party fee.

You agree that we may send service-related messages, including confirmations, reminders, receipts, security notices, and account-access links. Marketing email or text messages are subject to any separate consent you provide and can be stopped using the unsubscribe or opt-out instructions in the message. Message and data rates may apply.

You agree to follow our Acceptable Use Policy. In particular, you may not:

• Attempting unauthorized access to the Site or our systems
• Interfering with the Site's security features or normal operation
• Using automated tools to scrape content, interfere with availability, or place bookings or orders
• Impersonating another person or providing false booking information
• Using the Site for any unlawful purpose

If you submit feedback, a review, testimonial, photo, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not violate another person's rights. You retain ownership of your content.

When you ask us to publish content or submit it through a feature intended for public display, you grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, format, and display it for operating and promoting the business. You may ask us to stop future use, subject to reasonable processing time and legal or archival obligations.

The Site and its original design, text, graphics, logos, and other materials belong to Topographical Touch Massage & Bodywork LLC or our licensors and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive right to use the Site for personal, lawful, noncommercial purposes. No other rights are granted.

The Site may link to or integrate services we do not control, including payment, maps, social media, review, or commerce providers. Your use of a third-party service is governed by that provider's terms and privacy practices. A link does not by itself mean we endorse all third-party content.

To the extent permitted by law, the Site is provided “as is” and “as available.” We do not promise uninterrupted access or that every description, image, or item of general information will be error-free. Results from services or products vary and are not guaranteed unless we expressly agree otherwise in writing.

Some jurisdictions do not allow certain warranty exclusions or liability limits. These provisions apply only to the extent lawful and do not limit rights that cannot be waived, including applicable consumer-protection rights.

We may suspend access, cancel a transaction, or refuse service when reasonably necessary to address a violation of these Terms, fraud, abuse, safety concerns, legal requirements, or risk to the Site or others. Provisions that by their nature should survive termination will remain in effect.

These Terms are governed by the laws of VA, without regard to conflict-of-law principles, except where the law where you live requires otherwise. Before filing a formal claim, please contact us and give us a reasonable opportunity to try to resolve the concern.

We may update these Terms as our services, Site, or legal obligations change. The date at the top shows the latest revision. Updated Terms apply prospectively when posted or when otherwise communicated as required by law.

If any provision is found unenforceable, the remaining provisions stay in effect. A delay in enforcing a provision is not a waiver. These Terms, together with policies and transaction-specific terms referenced here, form the agreement concerning your use of the Site.
